Terms and Conditions


PLEASE READ THE TERMS AND CONDITIONS OF THIS AGREEMENT

By completing payment you are confirming that you have read, understood and are agreeing to the terms & conditions and cancellation policies outlined below.

Between: You (The Member) and Boom Fitness (The Gym).

1.0 GENERAL

1.1 All agreements must be paid for in advance. Memberships will not be confirmed until payment has been received.

1.2 I understand there are inherent risks in participating in a program of strenuous exercise. If I sustain or claim to sustain any injury while participating in the program, I acknowledge that Boom Fitness and the coaching team are not responsible - except where the injury was caused by gross negligence or by an intentional act of the coach.

1.3 I will adhere to all instructions given to me by Boom Fitness staff.

1.4 I understand my progress is dependent upon my effort, cooperation, consistency and adherence to the program both inside and outside of the training sessions themselves.

1.5 I understand that opening times are subject to change and will vary from the regular schedule over holiday and Bank Holiday periods.

1.6 I understand that I must give at least 6 hours notice to cancel a booked session. This is to allow enough time for somebody else to register. If I late cancel or do not show up, I will forfeit the session credit.

1.7 I understand that frequent late cancellations and no-shows may result in me being unable to book subsequent sessions on the app until I have had a review with a Boom coach.

THE MONEY BACK GUARANTEE

1.8 I understand that in order to be eligible for the action takers guarantee (if appropriate) I must meet the following criteria:

1. Attend at least 3 coached sessions (2 Group Personal Training sessions and 1 TEAM session) per week at Boom Fitness (every week)

2. Use MyFitnessPal or the Boom app to record my food/drink intake and hit my nutrition targets (set by Boom Fitness) every day

3. Complete all relevant check-in forms and questionnaires in the app every month for the full duration of my membership.

4. If after completing all of the above I still haven't seen results, I will book in for a refund eligibility call to discuss next steps.

2.0 CONTRACT DURATION & RENEWAL

2.1 I understand that by completing payment and agreeing to this contract I commit myself to minimum contracted term of 1 month, with 'Next Payment' cancellation terms whereby I will give one months notice of cancellation.

(See Section 5 for full cancellation policy).

2.2 I understand that this agreement is in force for a rolling calendar month from the agreement start date - this commences when payment is successfully processed.

2.3 I understand that once I go past the minimum term set out in my agreement I will automatically enter a rolling monthly agreement.

3.0 PAYMENTS

3.1 The Member agrees to pay monthly recurring fees (as appropriate for the selected membership) for every month’s membership at Boom Fitness via recurring card payment through the Stripe payment system.

Note: This contracted membership allows attendance to 4/8/12 small group personal training sessions and 10 team training sessions per month at Boom Fitness.

Unused sessions DO NOT carry over from month to month or billing period to billing period.

3.2 I agree to purchase a recurring membership at Boom Fitness as an automatic charge to my credit/debit card every month which then automatically enters into a rolling monthly contract unless requested to be cancelled by myself with ONE PAYMENT's notice.

3.3 I hereby certify that I am the holder of the credit/debit card detailed when signing up to this contract via Stripe.

3.4 I understand that access to the booking system will be blocked after 2 failed payment attempts and my service will be deactivated if my account becomes more than 28 calendar days late.

4.0 MEMBERSHIP PAUSES

4.1 Membership Pauses are not possible during the initial 28 day trial period. However a discretionary extension may be granted to 28 day challenge members where necessary.

4.2 Once a rolling monthly contract has been entered - Membership Pauses are limited to 60 days (2 payments) per calendar year, in 30 or 60 day increments only.

4.3 All Membership Pause requests require 28 days notice before the next scheduled payment date - any requests received later cannot be processed until after the next scheduled payment.

4.4 Upon expiration of any pause period, membership payment will automatically reactivate and resume.

4.5 If you choose to cancel your membership during the pause period you must follow the normal cancellation procedure outlined below.

5.0 MEMBERSHIP CANCELLATIONS

5.1 All membership cancellations are subject to a 'next payment' notice period. This will incur your full next payment. For example, if your payment goes out on January 1st and you cancel on December 31st, Jan 1st will be your final payment.

If you cancel on January 2nd, the final payment will be your next payment on February 1st.

Note: You will, of course, be able to continue at Boom Fitness for the full period that you have paid for.

5.2 To start the cancellation period, contact a member of the team and they will forward the Cancellation Request Form to you within 24 hours. This form

must be completed to trigger the cancellation period.

5.2 Memberships that are paid in full/upfront are non-refundable.

5.3 If you cancel then decide to come back, the membership rates in effect at the time of your return will be applicable.

5.4 These terms are NOT flexible so if you don’t intend to adhere to these terms then please DO NOT sign up.

6.0 AGREEMENT

6.1 I understand that by completing payment and taking up membership at Boom Fitness I am entering a contract and agreeing to the terms and conditions outlined above.
